1. Acceptance of Terms

By accessing or using HBOTT.com (“Website”), booking a session, or receiving any services (“Services”) from iCancierge, you (“Client” or “You”) agree to these Terms of Service (“TOS”).

If You do not agree with any part of these TOS, do not use the Website or Services.

2. Services Overview

iCancierge provides mobile Hyperbaric Oxygen Therapy (“HBOT”) and related wellness services, both on-location (“Van Services”) and through the Website.

All Services are provided subject to completion and electronic signature of required intake, consent, and screening forms.

3. Client Responsibility & Medical Disclaimers

No Medical Advice: All content, information, and advice on the Website or provided by iCancierge staff is for informational purposes only and does not constitute medical advice. Always consult a licensed healthcare professional before starting or stopping any treatment.

Self-Screening Required: Client must truthfully and completely fill out all medical screening questions. Failure to disclose relevant medical history (e.g., claustrophobia, lung issues, seizures, pregnancy, specific medications) transfers all risk to Client.

Treatment Risks: HBOT involves elevated atmospheric pressure and increased oxygen levels. Possible risks include barotrauma, oxygen toxicity, ear/sinus pain, temporary vision changes, claustrophobia, and other adverse effects. Client assumes full responsibility for any complications.

No Guarantees: iCancierge makes no representations or warranties—express or implied—regarding outcomes, effectiveness, or specific results of any HBOT or wellness service.

4. Eligibility and Contraindications

Client affirms they have reviewed and understand contraindications (e.g., untreated pneumothorax, certain chemotherapy agents, metal implants, pregnancy).

If screened and determined by iCancierge staff to be at risk, Client may be denied service.

Client agrees to notify iCancierge immediately if their medical condition changes prior to any session.

5. Payment, Booking, and Cancellation

Payment Methods: We accept credit/debit cards (processed via Authorize.net), cash, and other methods disclosed at booking.

Deposit & Fees: A non-refundable deposit may be required to secure a session. All fees are as quoted at time of booking; iCancierge reserves the right to adjust pricing.

Cancellation Policy: To cancel or reschedule without penalty, Client must provide at least 48 hours’ notice via the online scheduling tool (e.g., Calendly). Late cancellations (less than 48 hours) or no-shows incur a cancellation fee equal to 50% of the session price.

Refunds: Refund requests must be submitted in writing to MobileWellnessGroup@gmail.com within 7 days of session. Refunds are granted at iCancierge’s sole discretion and subject to any third-party processing fees.

6. Assumption of Risk & Waiver of Liability

Assumption of Risk: Client understands HBOT carries inherent risks. By booking and attending a session, Client voluntarily assumes all risks, known or unknown.

Waiver of Liability: To the fullest extent permitted by law, Client releases, waives, discharges, and covenants not to sue iCancierge (and its officers, directors, employees, contractors, agents, affiliates, successors, and assigns) from any and all liability for any injury, illness, wrongful death, or damages arising out of or relating to the use of Services.

7. Intellectual Property

All content on HBOTT.com (text, graphics, logos, images, videos, software) is owned by iCancierge or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

Client may not copy, reproduce, distribute, publicly display, or create derivative works without iCancierge’s express written permission.

8. Third-Party Services & Links

The Website may contain links to third-party sites (e.g., Calendly, Google Forms, Authorize.net) or embed such services for scheduling, intake, and payment. iCancierge does not control these third parties and is not responsible for their policies or practices.

Use of third-party providers is subject to their respective terms and privacy policies.

9. Communications & Marketing

By providing email or phone number, Client consents to receive appointment confirmations, reminders, and occasional promotional content via email/SMS. Standard messaging/data rates may apply

Client may opt out of marketing communications at any time by clicking “unsubscribe” in emails or replying “STOP” in text messages.

10. Privacy & Data Protection

iCancierge collects, stores, and processes personal and health-related data as described in the Privacy Policy.

All medically sensitive information is handled with HIPAA-like safeguards, even though iCancierge is not a covered entity under HIPAA.

11. Disclaimer of Warranties

Services and Website are provided “as is” and “as available,” without any representation or warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.

iCancierge does not guarantee uninterrupted or error-free access to the Website.

12. Limitation of Liability

Maximum Liability Cap: To the fullest extent permitted by law, iCancierge’s total liability for all claims under these TOS shall not exceed the total amount paid by Client to iCancierge in the 12 months preceding the claim.

In no event shall iCancierge be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, or personal injury, even if advised of the possibility of such damages.

13. Governing Law & Dispute Resolution

These TOS shall be governed by, and construed in accordance with, the laws of the State of California, without regard to conflict of law principles.

Any dispute arising under or relating to these TOS shall be resolved exclusively in the state or federal courts located in San Diego County, California. Client and iCancierge hereby submit to the personal and exclusive jurisdiction of such courts.

14. Severability

If any provision of these TOS is held to be invalid, unlawful, or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force.

15. Changes to Terms

iCancierge reserves the right, at its sole discretion, to modify these TOS at any time. Notice of changes will be posted on the Website. Continued use of the Website or Services after changes signifies acceptance of the updated TOS.
